President upholds decision advising NBP to pay PKR 500,000 to bank fraud victim

Islamabad, January 12, 2022 (PPI-OT):President Dr Arif Alvi has upheld a decision of the Banking Mohtasib advising the National Bank of Pakistan (NBP) to pay PKR 500,000 to a citizen who had been the victim of bank fraud at the hands of a former branch manager. He ordered that the bank must return the lost money to the victim and expressed dismay that the bank refused to own up to its responsibilities when a fraud had been committed by the employees of the bank against its customers.

Mr Muhammad Abdul Rasheed (the complainant), a resident of Faisalabad, had opened a bank account with the Hassan Road Branch, Jaranwala, and had handed over cash of Rs 500,000 to the then manager, Mr Akhtar Hussain, who gave the complainant a duly signed and stamped deposit slip.

Later, upon visiting the Branch to get his chequebook, the complainant came to know that an internal fraud had been committed by the then branch manager and he was one of the many victims of bank fraud and his money had not been deposited in his account by the manager.

56 affected accountholders submitted their claims to the bank amounting to Rs 98.018 million for refunding their defrauded amounts. Mr Abdul Rasheed also approached the bank to receive his claim but has was not provided with any relief. Subsequently, he sought the assistance of the Banking Mohtasib to retrieve his lost amount who ordered that the bank pay the complainant his lost money.

NBP then filed representation with the honourable President against the decision of the Mohtasib. President Dr Arif Alvi rejected the representation of the bank on the grounds that the deposit slip carrying the manager’s signature and stamp constitutes a valid receipt and binds the bank to honour it.

He upheld Mohtasib’s observation that although the bank manager had been dismissed by the bank and FIA was investigating the matter, the proceedings of the Mohtasib are of civil nature and are independent of any criminal prosecution by the FIA. He further noted that the complainant was dealing with the authorized agent of the bank who was not only in active service of the bank as the Branch Manager but had received the cash during banking hours within the premises of the bank against a valid deposit slip.

While terming the act of the ex-manager an act of maladministration and malpractice, the President further observed that the perusal of the relevant sections of the Federal Ombudsmen Institutional Reforms Act, 2013 shows that in matters falling within the jurisdiction of the Banking Mohtasib, the jurisdiction of other courts or authorities is excluded.

He wrote that the bank was given ample opportunity to refute the claim of the complainant and it failed to discharge the burden and statutory liability cast upon it under the law. Since no justification has been made to upset the original order of the Mohtasib, therefore, the representation of the bank is devoid of any merit and deserves to be rejected, he ordered.

UP deputy CM defends Haridwar genocide call

New Delhi, January 12, 2022 (PPI-OT):Keshav Prasad Maurya, the Deputy Chief Minister of the Indian state of Uttar Pradesh vehemently justified the genocidal speeches made at Haridwar’s Dharam Sansad only to realize his folly during an interview. The next moment he abruptly stopped the interview and started forcing the interviewer to delete the video clips related to the interview.

Finding the interviewer un-obliging, the minister flew into a rage calling him an “agent”. He snapped at the poor reporter and snatched his mask while asking his security men to delete the portion of the interview from the video footage where he defended the indefensible in reply to a query on the Dharm Sansad call for genocide of Muslims.

Before stopping the interview midway, he tried to justify what was said by Hindutva hate mongers at the two-day event in December last year. The priests had given an open call for genocide of Muslims calling upon Hindus to take up arms for establishing Hindu Rashtra.

The call for genocide was followed by a huge outrage and overall condemnation throughout the India. While prominent citizens from different quarters reacted to the provocative speeches with shock and dismay, Prime Minister Narendra Modi and Uttarakhand Chief Minister and the ruling Bharatiya Janata Party (BJP) kept a studied silence so far.

Maurya is probably the first BJP leader to speak up on the issue but the fact that he spoke in defence of the hate mongers may not go well with the party.

Asked whether leaders should assure that they are not against a particular religion, Maurya said, “We don’t need to prove ourselves. We believe in ‘Sabka Saath, Sabka Vikaas (development and support of all). The seers have the right to express themselves from their platforms.”

He further said, “Why are you only asking about Hindu leaders? What about comments made by other religious leaders? How many had to leave Jammu and Kashmir before Article 370 was scrapped, why don’t you talk about that? When you raise questions, they should not be for only one group. Dharam Sansad is not a BJP event. It is of religious leaders”.

Pointing out two hate preachers, Narsinganand and Annapoorna, from Uttar Pradesh are vitiating the atmosphere, the BBC Hindi reporters asked Maurya as to what action was taken against them. To this, he again went on to defend the genocidal calls by saying, “The seers can say what they believe in. This is not related to politics. And there are Muslim and Christian leaders too. Talk about them too.”

When pressed further for his stand on the genocide calls given at the hateful religious event, Maurya made a wane bid to backtrack, saying, “I don’t know what video you are talking about. Are you asking about elections? You are not talking like a journalist. You are talking like the agent of a specific group. I won’t talk to you. ”

The Deputy Chief Minister then took off his mic as the video abruptly ended. Meanwhile, social media users reacted to Maurya’s justification for genocide calls with anger and outrage. Prominent social activist Kavita Krishnan slammed Maurya for justiying genocide call.
