President Dr Arif Alvi directs state life to pay over Rs 1.6 million to families of deceased life insurance policy holders

Islamabad, December 12, 2021 (PPI-OT):President Dr. Arif Alvi has rejected four separate representations, filed by the State Life Insurance Corporation of Pakistan (SLICP) against the decisions of Federal Ombudsman, ordering it to pay a collective sum of over Rs 1.6 million to families of the deceased life insurance policy holders.

The corporation had refused to pay the amount assured in the life insurance policy on the flimsy ground stating that the insured persons did not deliberately disclose their pre-insurance ailments at the time of obtaining the policy.

The President upheld the decision of the Wafaqi Mohtasib and ordered that SLICP must fulfil its contractual obligations and pay up on the policy, besides reporting compliance to the Ombudsman within 30 days. As per the details, Mr Shakeel Zafar Khan, Mr. Muhammad Nawaz, Mr. Ghulam Yaseen, and Mr. Tanveer Hussain had obtained life insurance policies from SLICP for the sums assured of Rs 700,000, Rs 500,000, Rs 210,000, and Rs 200,000 respectively.

Subsequently, the insurance policy holders expired and members of their family filed separate insurance claims, which were repudiated by SLICP on the ground that the deceased policy holders had pre-insurance ailments which they had concealed at the time of obtaining the policies.

Feeling aggrieved, the family members of policy holders approached Wafaqi Mohtasib to seek justice. The complainants contended that the deceased persons had no pre-insurance diseases and the insurance claims had been rejected unjustifiably.

The Wafaqi Mohtasib, having investigated the cases, noted that the onus to prove that the policy holders suffered from some disease before obtaining the policy and wilfully hid the facts from the insurance agency rested upon SLICP. It further stated that the insurance agency must present evidence regarding the existence of alleged pre-insurance ailments and its knowledge on the part of policy holders.

The Mohtasib observed that in the instant cases, the agency had failed to present any evidence or diagnostic assessment to corroborate the claim of SLICP. It further noted the fact that all four field officers of the agency had categorically declared that the deceased were healthy at the time of the issuance of the policy.

The Mohtasib, therefore, ordered SLICP to fulfil its contractual obligations by making payments of the full policy claims to the complainants, besides asking SLICP to look into its procedures for the issuance of medical and non-medical policies so that claims of good health or otherwise were duly filtered at the proposal stage. Later on, the SLICP filed four separate representations with the President against the decisions of the Mohtasib.

The President upheld the decisions of the Wafaqi Mohtasib and referred to the Section 80 of the Insurance Ordinance, 2000, which provides that no policy claim after two years from the date it was effected may be called into question on the ground that a statement made in the proposal for insurance or in any report of a medical officer was inaccurate or false. He also noted that the documents produced by SLICP pertained to post-insurance ailments and no document had been presented which proved the existence of disease at the time to obtaining the policy.

The President also quoted a decision of the Lahore High Court which rejected hypertension, diabetes and mellitus as exceptional reasons for rejection of insurance claims. The court, in its decision, had held that majority of people suffering from such ailments, by remaining more careful in their life time, lived either for decades or longer than people not having such diseases, therefore, the concealment of such diseases could not be termed as done fraudulently.

The President in his decisions wrote that in view of the facts of the cases, the maladministration on part of the Agency stood established, therefore, the representations of SLICP were rejected. “SLCIP must report compliance to the learned Ombudsman within thirty days”, the President further directed.

Omar reacts to Haryana CM’s ‘namaz’ remark, questions IIOJK’s link with India

Srinagar, December 12, 2021 (PPI-OT):In Indian illegally occupied Jammu and Kashmir, National Conference Vice President Omar Abdullah on Sunday strongly responded to chief minister of Indian state of Haryana, Manohar Lal Khattar’s remark over the issue of people offering namaz in open and said that Jammu and Kashmir never merged “with this India”.

With several Hindu outfits objecting to Friday prayers being offered in open in Gurgaon, Haryana Chief Minister Manohar Lal Khattar recently said that the practice of offering namaz in the open “will not be tolerated”. Responding to Khattar’s statement, Omar Abdullah said, “It would have been fine if this restriction was on every religion but policy of pick and choose shows a particular religion is on target. J and K didn’t merge with this India.”

“The practice of offering namaz here (Gurgaon) in open spaces will not be tolerated. But we all will sit to find an amicable solution,” the chief minister told reporters in Gurgaon, responding to a question on the objections raised by several right-wing outfits. Over the past some months, members of some Hindu outfits have been gathering at sites where the Muslim community offers ‘namaz’ in open space, and raising “Bharat Mata Ki Jai” and “Jai Shri Ram” slogans.

Suppression of free speech becomes feature of Modi regime in India

Islamabad, December 12, 2021 (PPI-OT):Suppression of free speech has become a feature of RSS-backed Modi regime as threats to freedom of speech have intensified in India since Modi’s ascension to power. A report released by Kashmir Media Service, today, said new forms of censorship are proliferating in Modi’s India, adding free speech in India, though apparently guaranteed in Constitution, is forbidden in reality.

It deplored that the BJP-led Indian government was silencing its critics even on Facebook and Twitter. It said that India was also a dangerous country for journalists as Modi and his Hindutva brigade had created an environment of intimidation for journalists. The report said that Reporters Without Borders, a France-based non-profit and non-governmental organization, had categorized India as bad for journalism, saying journalists are exposed to every kind of attack even police violence in India:

It said, journalism has become a crime in India under Modi-led fascist Indian government, adding the BJP government uses draconian laws to silence dissent in India. The report urged the world community to take urgent steps for holding Modi regime accountable for suppression of free speech in India.
